Ok after fighting the people who had my car on friday (long story!) and not getting it... I went back to try again today they wanted to charge me 700+ dollars to get my car out [$300 storage, 235 towing (1 mile btw) and the rest fees and taxes!] I was naturally pissed and asked to talk to the manager. He was gone for the day they said....it was 1:50pm. So I told em I was going to talk to the guys insurance company and see what they could do. As I was walking back to the car to get the info, my phone rang. It was the guys adjuster who told me he had come on friday to look at the car. I explained how they were trying to RAPE RAPE RAPE me on charges and he told me to file a complaint with BAR (Bureau of Automotive Repair) and AAA. Then the lady comes that I was fighting with at the shop comes out and finds me to tell me that the boss is here. I went to talk to him and he said to 'wait and see what the insurance company is going to do, if they don't cover you, then I will charge you the 150 for the 3 days' <---- that is fair so I said thanks and I was on my way...
Now the guy that called whom came to do an estimate on my car said that they would declare it a total loss and said that without even checking it machanically, the cost is 4000-5000 bucks. He wasn't able to tell me what he thought it was worth but told me that it costs you 15% of the value to buy it back... So lets say my car (and I think it is) is worth 5500 (according to similar cars HT,NA etc....) that would be about $825 for my car back. This would assume that they would say 'Yeah Colin your positively right! your car is worth that much! Here you go!) but that is a uphill battle that might not even be fought...
Bottom line is that I'm still waiting...  and a 1% chance that insurance will be involved... So in light of that, I'm leaning towards a civil suit.

First off, I already had a feeling where this was going when you said your car was at a tow yard. I didn't think it was that bad for the car to get towed. Yup, tow yards are daym rip offs. Sorry you hare having this Colin. I hope the other insurance company takes care of this for you. Every day that damn meter is going up and thats how tow companies make the most of thier $$$.
I guess its really up to you if you want them to declare it total. That means your will have a salvage title. On the bright side, you can buy the car back really cheap plus you have about $4K in your pocket. That will sure go a long ways with the car of what you have planned (paint job, swap etc...) I would start compiling history tho just in case you want to sell it in the future and you can show that buyer exactly what happened which is really just minor.

Daym Christian, you trying to race someone or something? Well glad you are ok. What are your plans now? Do you have full coverage at all? If so, have the insurance fix the car. It will be on your record anyway so no matter what your insurance will go up. Might as well take advantage of what you've been paying for.
