Yes if you'e not careful that can happen, but since the straps are long enough, I use that to tie the bike down so it won't move while I drive. My rack also takes 3 bikes, but since I only have mine, that's not a problem, plus it would be pretty cramped to get 3 bikes on that thing. Also, just don't use the innermost brackets when you mount it so it's not all the way next to the car. Just tie it so it doesn't move and that should do the trick. Not perfect but it works. Don't leave your straps hanging like the picture though.
I should mention that mountain bikes will look weird like the picture, you will always have one side that looks way higher than the other. It works fine, but just looks weird. At first you think you don't have something right, but that's just how the frames are so they won't sit nice and even.

ive used one of those too.. they're terrible. it WILL damage your (at a minimum!) paint. can take chunks out of your spoiler and bumper if it slips..
it works in a pinch, id strongly suggest not relying on one though.
