Why was she issued a ticket?

My Neice was backing out of a parking space, stopped when she saw the oncoming truck, he hit her anyway.

Why would she get a 2 point ticket for "backing up when not safe".

This happened in Colorado.

I would assume because there was not a video of the occurrence, and usually the people backing up are at fault. maybe not in this case, but that usually is how it goes here.

I don't have my vehicle code with me right now so I can't quote the exact law. However it falls under the "unsafe starting/backing" code. It happened to me a long time ago, too. Even though I was fully stopped because I saw it coming, it was still my fault.

that sounds a bit like starting your car with the sun-guard(reflector over the dash)would also break that code too?

Yes, and she didnt hit the front of the other car she hit it in the rear wheel well. so pretty much her fault totally.
Also found out that the other drivers insurance has lapsed so he wasnt covered at all. The other driver was driving a pickup owned by his employer they have a fleet of over 40 trucks and this one was not insured.

By starting they mean making the vehicle move, not turning the engine over. If you did, for some crazy ass reason, decide to start driving with the reflector still in the windshield that could potentially fall under this code or the "Obstructed Windshield" code.

Yeah..the second statement is more true as I am finding out. At first I thought she backed into the front of his truck. Turns out she was backing up as he was driving by...hit him in the rear quarter panel.

haha, nah, not putting it in gear. i just remember reading a warning label on a reflector that said "WARNING: do not start car with this in windshield."

so I thought I'd ask.
