Same in California. You're the legal owner until you release liability (by accepting to junk it), so you get to decide whether or not to keep it. It's basically called a "buy-back" as they take money from whatever amount they agreed to give you.

When my MKII was totalled in 2003 after getting rear ended at like 2mph (a joke, right?), I got $4600 to keep it. They were willing to give me $5400 if I junked it, but I bought it back for $800, kept the car, and got a check for $4600. It's listed as Salvaged, but only the rear body panel was dented. The Tahoe totally missed the bumper, so nothing happened to the frame. It was just sheet metal damage.

Um, FYI.... there is no frame in an MR2... it's a unibody, so not hitting the bumper at low speed (which is what they are designed to do) actually caused more unibody damage than if they had hit the bumper....


back to the OP.....

if the insurance didn't give you an option to get the car back and you have not yet accepted their offer.... they cannot do anything with the car (unless there are specific state regulations that tell you how long you have to get it out of a tow yard).... In any event, contact your states insurance commissioners office and file a claim at the very least. Also notify the insurance company that you have done so.

ok, so good news. his insurance paid me A LOT more than i need to repair it. i found a fender, but i still need a hood, and the number of a good toyota mechanic in Colorado.

Congrats man, a similar thing happened to me last summer when some cracked out 55 year old man driving his dad's car t-boned me. Insurance companies are no better than sketchy used-car lots.

People here will definitely help you out, I bought my MK2 from Duecegirl03 and Mark_Dorman for a really good price. This committee looks after their own! I have some random odds and ends from my MK1, you can have them. Just pay for the shipping.
